Sexual Assault and Rape Colorado State Law
Sexual assault is when someone knowingly sexually penetrates or intrudes upon someone who does not consent, is unable to render consent, or is under the state's legal age of consent (age 17). Unlawful sexual contact is a separate crime in which a person touches a victim's intimate parts, or when the victim is coerced into touching the offender's intimate parts.
The punishment for sexual assault varies based on the violence and nature of the case. If charged with a Class 2 Felony in the most serious of cases, penalties include at least 16 years in prison and fines up to $1 million. For sexual assault classified as a Class 1 Misdemeanor, the punishment includes at least 6 months in prison and fines up to $5,000.
