What Can I Expect during this Process?

Every divorce is different, and the process and timeline for reaching dissolution varies depending on the facts of your case.  The minimum time for final dissolution is 91 days, but a divorce can take many months or years if your situation is complicated by complex asset division and disputes regarding children.

Colorado is a no-fault divorce state, which means the only reason that needs to be cited is irretrievable breakdown of the marriage. There is no requirement to prove fault, and no tactical advantage gained by doing so.

In general, you or your attorney files a summons and petition with the court and serves it on your spouse. Your spouse then has 21 days (35 if living outside Colorado) to file a response.

Your divorce attorney will personally handle every stage of your case, benefiting you in the courtroom and in the conference room.

You have 42 days (from the date of service) to file your financial disclosures. A qualified divorce attorney can help prepare your disclosures, examine your spouse’s disclosures and assist in formulating settlement goals, including asset division, support and living arrangements.

Then, negotiations on the settlement agreement begin. If you and your spouse are unable to reach an agreement, you may need to appear in a court hearing before a judge. It takes time to get on the court’s schedule, and then the pre-trial procedure can also take extensive time. In the end, a judge issues permanent orders.
