DD&G Obtains Dismissal In Aggravated Motor Vehicle Theft Case
Joseph W. Galera recently obtained an outright dismissal for a client who was unjustly charged with Aggravated Motor Vehicle Theft. The charge of Aggravated Motor Vehicle Theft was charged as a class 5 Felony in Denver District Court. The presumptive penalty for a class 5 Felony in Colorado is imprisonment in the Colorado Department of Corrections (DOC) for between 1 to 3 years along with a possible fine of between $1,000 and $100,000. However, our client was also facing habitual criminal charges based upon his past criminal history which would have increased the penalty to a mandatory prison sentence of 12 years with no possibility of probation. Our client was adamant that he was not guilty and we believed him.
