Removal Proceedings in Colorado

The judicial atmosphere regarding parent relocation has changed over the past few years.  Colorado courts were formerly adverse to removing children from the jurisdiction under the presumption that is was harmful to the child's relationship with the non-custodial parent.  After recent rulings, judges are more neutral on the issues and are required to evaluate removal on a case-by-case basis using a "best interests" standard.

It is critical to have veteran representation.  I prepare clients to present a compelling argument for or against the relocation in the parenting time modification hearing, and to anticipate questions the judge or opposing counsel will ask:

l What is the reason for moving (or why do you object)?
l What extended family or support would the child have in each              location?
l What educational and cultural opportunities would the child be              exposed to (or denied)?
l Has the petitioning parent been the primary caretaker of the child          since birth?
l Will the parent left behind have reasonable child visitation and be          able to participate in parental decisions?
