Custody and Support Modifications

Experienced Colorado Family Lawyer

Altering child support, alimony, child custody, or parenting time requires a significant change in circumstances. The Law Offices of Fred Andrew Dunsing vigorously protects your rights in seeking or challenging a motion for modification.

I have practiced law in Colorado since 1998, helping hundreds of clients as a solo practitioner in family law. I invite you to a free consultation to discuss your custody or support modification case. You will meet with me and I will personally handle your case. I make sure you are thoroughly prepared for the hearing, and stand by you in court to look out for your interests.

Child Support and Spousal Maintenance Modification

Colorado law requires a "substantial and continuing change" in personal circumstances of either party to approve modification of child support. The general benchmark is a 10 percent increase or decrease in the support obligation, such as a big raise or an employment layoff. I also represent clients in petitions to terminate child support or maintenance.

Often the other parent or ex-spouse tries to shield assets through family or friends, or exaggerates child-rearing expenses. I have an M.B.A. and a record of success in uncovering hidden income and assets of the other party. I protect your interests by ensuring that the court has full and accurate financial information in ruling on the petition.

Custody and Visitation Modifications

Parenting time and physical custody of children can also be modified for a variety of reasons:

  • Change in work schedules
  • Petitions for shared custody / increased parenting time
  • The child wants to live with the other parent
  • Allegations of substance abuse, or physical or emotional abuse of the child
  • Relocation of one parent (out of state, or within Colorado)

The court considers the best interests of the child. I know the tendencies of many family court judges in the Denver and Vail Valley areas.
