Custody of Grandchildren

Grandparents can petition a court for custody of their grandchild(ren) under certain circumstances.

Usually, the grandchild(ren) must have been in the grandparent's physical care and control (or someone other than the parents) for a period of six consecutive months prior to the filing of the petition for a grandparent to have "standing."

In both actions for grandchild custody and for grandparent visitation, a court will consider the best interests of the grandchild(ren), and particularly  the previous relationship of the grandparents and grandchildren.

Visitation Rights for Grandparents

After a bitter divorce or break up, or after trauma caused by the death of a grandchild's parent, the custodial parent may terminate all contact between children and their grandparents.  However, the State of Colorado recognizes the legal right of a grandparent to have reasonable contact with their grandchildren.  Unfortunately, grandparents may have to bring a legal action for grandparent visitation to enforce this right.  "Reasonable contact" means periodic visitation that does not interfere with the custodial parent's parental rights.  The parent and the grandparents may agree on the arrangements.  If they cannot, then a family court will order what reasonable contact shall be.
