Marital Property and Separate Property Colorado law considers all wealth acquired during the marriage as marital property to be divided. Litigation often centers on which assets are separate property (held under the individual's name and/or acquired before the marriage). For example, one spouse starts a business before marrying, and it grows into a profitable enterprise during the marriage — how much of its value is included in the division of assets? Likewise for retirement accounts and all assets. I hold an M.B.A. and have wide experience in litigating these matters. Equitable Distribution Colorado does not require a 50/50 split of assets, only that the division be "equitable." I consider all factors to negotiate or litigate a division that is fair to my client. If the other spouse is keeping the house, for example, my client must be compensated from other assets for the equity in the home.
